Do You Need a Permit for a Patio or Retaining Wall in Western NC?

Permits are one of the least exciting parts of planning a hardscape project — and one of the most common places homeowners get surprised. Here's a straightforward look at what usually requires a permit in Burke, Catawba, McDowell, and Caldwell counties, what doesn't, and why we handle this step for you either way.

What Usually Doesn't Need a Permit

A ground-level paver patio that isn't attached to the house and doesn't involve electrical, gas, or plumbing typically doesn't trigger a building permit on its own in most of our service area. Same goes for a standalone fire pit, a walkway, or a short retaining wall under 4 feet. That covers a large share of the projects we build.

What Usually Does

• Retaining walls over 4 feet (measured from the bottom of the footing to the top of the wall) — this is the big one, and it applies consistently across Burke, Catawba, McDowell, and Caldwell counties. Walls this tall need engineered drainage and typically a stamped design.
• Anything attached to the house — a covered patio, an attached pergola, or a structure that ties into the roofline usually falls under the same permitting as an addition.
• Outdoor kitchens with gas or electrical — a gas line for a grill or electrical for lighting and appliances needs its own permit and inspection, separate from the hardscape itself.
• Pools and anything with a required safety barrier — different rules, but relevant if your patio project is part of a larger pool build.
• Large impervious surface additions — some jurisdictions and HOAs cap how much of a lot can be covered by patios, driveways, and other hard surfaces, particularly relevant on lake lots near stormwater-sensitive shoreline.

Permit Rules Aren't Identical County to County

Burke, Catawba, McDowell, and Caldwell counties all administer permitting a little differently — different fee schedules, different inspection scheduling, different turnaround times. If your property borders Lake James or Lake Rhodhiss, you may also have Duke Energy shoreline requirements layered on top of the county's. None of this is meant to be a DIY research project for you — it's exactly the kind of thing that's easy to get wrong from a general web search and expensive to fix after the fact.
